Parking Violations

The Parking Rules and Regulations are in effect 24 hours a day, 365 days a year, including legal holidays. New York State Vehicle and Traffic laws apply to the use and operation of all motor vehicles upon all properties owned or leased by the University at Albany. Policies and procedures are subject to change with approval from appropriate authority.

Each administrative violation carries a penalty of $20.00. Each parking violation carries a penalty of $20.00, except for illegal parking in a handicap area, which carries a penalty of $50.00. Vehicles may be ticketed for multiple violations, including illegal parking, non-registration, display of unauthorized decal, and/or non-payment of the comprehensive/parking fee. As a courtesy, vehicles remaining illegally parked in the same parking space will not be held responsible for more than one ticket per calendar day.

Responsibility for all parking violations lies with the individual that registered the vehicle with the Office of Parking and Mass Transit Services. If the vehicle is not registered with Parking and Mass Transit, responsibility lies with University members. University members are responsible for violations of family members.

All tickets issued for a violation will record vehicle description and licensing information, time issued, parking decal and fee tag numbers, and the badge number of the citing officer. Tickets will also note location of violation and specific offense(s), with corresponding fine.

For record keeping purposes, all tickets must have either a parking violation or a parking violation coupled with an administrative violation. The ticket must include the badge number of the officer witnessing the violation and shall be served upon the offender or attached to the vehicle involved.

Parking Tickets

Appeals must be submitted within 14 calendar days following the date of issuance. Parking tickets can be appealed by students and faculty/staff by using My UAlbany. Visitors may download an appeal form at www.albany.edu/pmts or you can come to the Office of Parking and Mass Transit Services to obtain a form. Decisions are generally made within 3-6 weeks using the same method in which the appeal was received.

The University Police and the Parking & Mass Transit Enforcement staff enforce parking rules with the following in mind:

Life safety infractions such as fire lanes, handicapped spaces, and maintaining access are paramount.

Protection of permit holder parking privileges must be provided

To maintain order and equality, so that our campus is accessible.

Fines for specific violations are shown in the table below. A $10.00 late fee is assessed on the 31st day after the date of issuance on tickets that are unpaid and not under appeal. Life Safety Infractions

* Pending regulatory review beginningJanuary 2010, in accordance with SUNY Rules and Regulations, a new schedule of parking fines will be in effect on-campus. The goal of the increase is to ensure compliance, thereby improving traffic flow and making more space available for legal permit holders.

Parking Ticket Payment

PMTS accepts online payments through MY UAlbany or www.albany.edu/pmts . Payments may be made in person at the Parking and Mass Transit Service, or by phone. The Parking office is open Monday through Friday, 7:30am-4:30pm. Checks should be made out to University at Albany, please include the ticket number(s) on the check. You may also mail payments to the following address:

The failure of a student to pay any fines due will prevent release of transcripts, diplomas, or certificates of completion; reinstatement or other sanctions. In the case of University employees, failure to pay will result in the deduction of such fines from wages or salary due for state employees. Failure of a visitor to pay any fines due will result in proceedings under Law. Failure to resolve outstanding tickets may also result in revocation of parking privileges, as well as the placement of enrollment holds on your record. Delinquent tickets may be transferred to the New York State Attorney General's Office or a private agency for collection.

If full payment or an appeal is not submitted within 14 calendar days following the date of issuance, this will be considered an admission of liability


Towing

Any motor vehicle operated or parked on campus in violation of these regulations may be removed or towed and stored at the owner's expense. All decal/permit numbers reported lost or stolen will be placed on a "hot sheet" and vehicles found displaying them will be ticketed and towed.

A vehicle will be released from the towing company only after ALL outstanding parking fines have been paid.

  • Tow list: A vehicle may be placed on the tow list for fines of $100.00 or more, or if the vehicle is not registered with Parking and Mass Transit Services. Vehicle owners may notbe notified in advance of being placed on the Tow List. A resident freshmen that has been granted an exemption to the resident freshman parking ban will be placed on the tow list after their first violation. Only when full payment of fines has been made will the vehicle be removed from the tow list.

    If a vehicle operated by a resident freshman displays a decal purchased by an upperclassman, holds will be placed on both students' records until the decal is returned. Referral to the Judicial Board may result in disciplinary action, including loss of parking privileges for an additional year.

  • Removal From Tow List (Except Resident Freshmen): A vehicle will be removed from the tow list when the vehicle is in compliance with University parking regulations and all outstanding financial obligations have been met with Parking and Mass Transit Services.

  • Removal From Tow List (Resident Freshmen): Resident Freshmen can remove their vehicles from the tow list if they receive permission from the Director of Parking and Mass Transit Services to purchase a decal; and make full restitution for all outstanding fines, or receive permission for a temporary registration (for a maximum of two weeks). In this case, the vehicle will not be placed on the Tow List until the temporary registration expires.

  • Towing Fees: The owner/operator of a towed vehicle stored in the contracted impound area may be charged a storage fee. Owner/operators of towed vehicles will also be charged a tow fee by the tow service.




Holds

Students have seven calendar days to respond to a citation before a hold is placed on their records.  Scheduling a second appeal does not remove a hold.
A pending second appeal does not remove a hold.



Parking Appeals

After receiving a ticket, Students and Faculty can file an appeal on-line at MyUAlbany. The decision by the Appeal Officer on the appeal will be communicated in the same method the appeal was submitted.  Should the decision be unfavorable, the individual may then request a hearing. Failure of the alleged violator to appear at the time fixed for a personal hearing, without notification of inability to appear, is equivalent to a plea of guilty. In such cases, no further hearing will be scheduled and associated fines will be imposed.

Students have seven calendar days to respond to a citation before a hold is placed on their records.  A pending second appeal or scheduling a second appeal does not remove a hold.

Appeal Hearings: The Appeals Board is designated by the Vice President for Finance and Business to hear appeals of campus parking violations. The Appeals Board consists of members of the University Community, which may include faculty/staff (with supervisory approval) and students. Members of the Appeal Board are separate from the Office of Parking and Mass Transit. The hearing board shall not be bound by the technical rules of evidence, but may hear or receive any testimony or evidence directly relevant and material to the issues presented. All decisions rendered by the Appeals Board will be final.



Repeat and Unanswered Charges

Upon the receipt of 10 campus traffic or parking violations during an academic year, a campus motor vehicle registration may be revoked for the balance of the academic year.

Three or more unanswered tickets in an eighteen month period by the same owner/operator regarding violations of campus parking regulations may result in a referral to the New York State Commissioner of Motor Vehicles for review in considering the renewal of an operator's license and/or a motor vehicle registration, and the imposition of a fee as approved by the Chancellor or his/her designee to meet the administrative costs of such a referral.



Method of Collection

Unpaid parking fines are subject to referral to the New York State Attorney General's Office for collection.

  • Students: Board of Trustees Resolution 76-137 as promulgated in Section 301.2(5) of Title 8 of the Official Compilation of Codes, Rules and Regulations of the State of New York states: "...Except where otherwise authorized, no person shall receive credit or other official recognition for work completed satisfactorily, or be allowed to re-register, until all tuition, fees and all other charges authorized by the University have been paid, or University loan obligations have been satisfied."

    Following this legislation, failure to pay parking fines may result in withholding of transcripts, registration, or diplomas of students. Tickets are processed daily and a hold is placed on academic records, including registration, transcripts, and diplomas, seven calendar days after the violation was written if no action is taken. Payment of all outstanding fines is required to remove a hold.

  • Faculty/Staff: Unpaid parking fines may be subject to payroll deduction for union employees of the University.
